When we are acting for you we are a data controller in respect of any personal data you provide to us or data to which we have access. Anyone working within our organisation is the data processor.
When we are instructed to carry out work for you a contract has been formed. We will therefore require to process your data as this will be necessary for the performance of the contract between us. Processing may also be necessary to allow us to comply with our own legal obligations and to protect your vital interests. When we do process data on your behalf we will comply with the relevant provisions of any applicable data protection laws.
In the event that we process special categories of personal data (as defined in article 9 of the GDPR Regulations) then it shall be on the basis that processing is necessary for the purposes of carrying out our obligations to you; necessary to protect your vital interests or another person where you may be physically or legally incapable of giving consent or necessary for the establishment, exercise or defence of legal claims.
We will not generally share your data with third parties except as is required for the performance of our contract with you or as required by law. For instance The Law Society of Scotland, as our regulators, are entitled to peruse files containing your data when they carry out firm inspections. We may store your data off site after the conclusion of the contract. Those with whom we share your data in the course of our business are also bound by the data regulations.
We do not anticipate that we will transfer your data outside the EU except as required by the performance of our contract with you.
We will keep your data for a minimum period of six years and thereafter we will destroy the hard copies of your data in accordance with the policy of The Law Society of Scotland from time to time
